Tickex Standard Terms and Conditions

We are pleased to welcome you to Tickex, and our online ticket search facility. We hope that you enjoy using our website and we look forward to helping you find tickets now and in the future. These terms set out the conditions which govern your use of our website and the relationship between us.

These Conditions (“Conditions”) will apply in place of, and prevail over, any terms or conditions (whether or not in conflict or inconsistent with these Conditions) contained or referred to in any documentation submitted by you or in correspondence or elsewhere or implied by trade custom, practice or course of dealing. The Conditions will apply to all aspects of the use of the site including the buying, searching of tickets and other services. A variation of these Conditions is only valid if we give notice in writing by posting such varied terms on the Website or by sending them by email. Any variation will govern new users from the date it is posted on the Website or it is sent by email, and existing users will be bound by the variation after expiry of 14 days following date of notice. "Tickex, " “We” or “Us” means Tickex, LLC

"Seller" means Affiliate, Vendor, Partner or Third Partyies

“Your Information" means any information you provide to us or other users in relation to the Tickex service including the registration, or feedback process (including, without limitation, any description of items listed), your postings on the message boards and any other content that you post within the Website. You are solely responsible for Your Information, and we act as a mere conduit for your online distribution and publication of Your Information.

2. Tickex

Tickex is a search engine for live event tickets. In no way do we sell or list tickets for sale on our website. We are not responsible for the ticket listings on our website as they are done through third party companies. Once you have clicked on a ticket listing you are then bound by the terms and conditions of the website you have clicked through too.

2.1 Tickex, is a search engine for tickets. We do not issue tickets, and in no way can we ensure that Seller will complete the transaction. We will not be held liable if a Seller does not complete a transaction.

2.2 Tickex, Guarantee.

  • That every ticket listing in our results is from a legitimate registered company, with all the proper legal credentials. i.e VAT number, incorporated etc.
  • That all companies in our listings have some sort of money back guarantee OR seller ranking system.
  • That each of our affiliates (vendors) have been in the market for some period of time (at least 6 months)

3. Becoming a Member/Registrating for our Newsletter and Personlized Search Sevices

To become a registered user of our Website you must agree to these Conditions:

  • Must be at least 18 years of age
  • Have a valid email address (to be used as your username)
  • Be able to enter into legal and binding contracts
  • Create a Password to be used in conjunction with your email address (which will be deemed your user name)
  • Have authority and capacity to contract

3.1 2 Emaid Address and Password

For access to the newsletter you must provide your email address. For access toand personalizsed search services you must have a valid email address and Password. The email address must be valid and the Password must be unique to you. You are solely responsible for maintaining the security of your username (ie email address) and Password and for all account activity that occurs under your email address and Password. If you should lose your password we will issue you a temporary password, sent to you by the provided email address.

4. Event Liability

4.1 Because we act merely as a facilitator and do not issue any tickets, unless otherwise stated, we do not accept any responsibility for any claims of any sort that take place in or on the way to the relevant event venue.

4.2 We are not responsible for personal arrangements including, travel, accommodation or hospitality relating to the event and in no way shall we be held liable for any loss of enjoyment or wasted expenditure.

5. Tickets

5.1 Lost Tickets. We will not be responsible for any ticket lost, stolen or destroyed as you did not purchase the tickets from us. In any case. i It is not always possible to issue duplicate tickets, for example (without limitation) to non-seated events where there is a possibility that both the original and duplicated tickets may be used, compromising the licensed capacity of the venue. Duplicates may be issued at the discretion of the promoter, not by Tickex,. If you have lost your ticket(s) Tickex, will not be responsible for the issuance of duplicate tickets as we do not issue any tickets.you should immediately contact the company you purchased your tickets from.

5.2 Event Information. Event dates, times, venues and subject matter, which are listed on our siteon the ticket are subject to change. It is up to you to check the status of the tickets with the venue and/or box office for any changes made to the event. It is not our responsibility to inform you of any changes.

6. Cancelled/re-scheduled Events

6.1 Cancellation. If the event is cancelled We will not be responsible for notification or refunds, that is up to the sole discretion of the ticket provider and the event promoter.

7. What you allow us to do, and your understanding of us.

7.1 Your Details and Third Parties. We reserve the right to pass on your details to the authorities if we feel that any illegal activity has occurred, or if the authorities ask us to. We will use best endeavours not to pass on your details to anyone or for other promotional reasons unless otherwise given permission by you or for reasons beyond our reasonable control.

8. Things that are Unacceptable in Usage with our Service

8.1 Illegal Activity. You agree to not take part in any illegal activity in conjunction with using our service including using our site to perform illegal activity.

8.2 Activities Not Permitted on our Site. Your Information and your activities on our Website must not:

  • be in breach of any applicable laws or regulations (including without limitation laws governing export control, consumer protection, unfair competition, anti-discrimination, false advertising, and rules governing sports events);
  • violate any relevant law, rules or regulations;
  • infringe any third party's intellectual property rights or other proprietary rights or rights of publicity or privacy;
  • be false, inaccurate, misleading, offensive or menacing, abusive, defamatory, or be in breach of confidence;

  • be designed or have an affect so as to interfere with, interrupt or disrupt the normal operating procedures of a computer or to intercept or access without authority or expropriate any system, data or personal information;
  • cause the Website to be interrupted, damaged, impaired or rendered less efficient.

9. If Our Rules are Broken

9.1 If you are suspected of breaking any of our rules or acting illegally we will investigate the claim. If we have sufficient evidence that you have broken our rules or the law we will determine the severity of the claim and either suspend you from using our service or terminate your membership completely, and if necessary report you to the necessary authorities.

9.2 If we catch you Breaking the Law or any applicable Rules or Regulations. If We suspect you of breaking any laws, rules or regulations in conjunction with using our service you agree that we may submit this activity to authorities, law enforcement officials or any relevant third party. If any laws , rules or regulations are broken with your membership you agree that we may hold, revoke or otherwise act as we deem fit with your pending payments or authorizations. You agree that we may charge your credit card if we need to replace tickets that were purchased from you and cannot be fulfilled.

9.3 Our Powers. We are under a duty to ensure that the Website is used in accordance with these Conditions at all times and accordingly we may take any action that we deem appropriate in our sole discretion including without limitation investigating any complaints made against you and violations of our policies, and issuing a warning, suspending or terminating service, denying access, removing a listing or recommending you edit a listing. You agree to cooperate fully with any investigations, including without limitation providing us specific information. You agree that Tickex, may report any activity that it suspects violates any law or regulation to appropriate third parties.

10. Your Promise to Us

10.1 You agree the all the information you provide to us whether it be verbal or written to be accurate and not otherwise misleading, inaccurate, false or fraudulent.

You warrant that any item you list for sale is not in any case fraudulent, counterfeit, stolen; does not violate any law, ordinance, statute or regulation.

10.2 You will not provide any information that includes in it any viruses or programming that is intended to damage, intercept, or interfere with our system and our users information.

11. Liability & Indemnity

11.1 You agree that the internet, by its nature, contains and utilises elements (both hardware and software) and relies upon services, input and facilities which are not within our control. Accordingly, you agree that the Website may cease to operate from time to time or be subject to interruption or interference, and in such circumstances, we shall be excused the performance of our obligations without liability. Tickex, reserves the right at any time to modify or discontinue, temporarily or permanently, the Website or any part thereof with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension or discontinuance of the Website or any services for any reason. In addition, the Site could be unavailable during certain periods of time while it is being updated and modified. During this time, the Site will be temporarily unavailable. .For these reasons, eexcept for the express warranties stated in these Conditions, Tickex, provides its services on an "as is" basis and "as available" basis without any warranties of any kind. Accordingly, Tickex, makes no warranty with respect to its software, any tickets, any event, or that sellers or buyers will perform as promised, and Tickex, expressly disclaims all such warranties, whether express, statutory or implied, including without limitation any warranties of quality, title, non-infringement of third party rights or fitness for a particular purpose subject to the extent it is permitted to do so by applicable law.

11.2 You acknowledge that (save to the extent that such waiver is prescribed by law), we will not in any circumstances be liable to you in contract, tort (including negligence) or otherwise for loss of revenue or opportunities, goodwill, reputation or any type of special, indirect or consequential loss, or loss of profit (even if such loss was reasonably foreseeable or we had been advised of the possibility of you incurring the same). Without prejudice to the above limitation in this paragraph we will not in any event be liable to you in respect of any default under these Conditions an aggregate amount in excess of the greater of (i) the amount we have received and are entitled to retain in relation to the sale or other service offered giving rise to the liability or (ii) the price of the ticket.

11.3 You agree to protect, indemnify and save harmless Tickex, (and any parent or subsidiary or employees officers directors or agents) from and against any and all damages, claims, suits, actions, judgements and costs and expenses whatsoever arising out of, or in any way connected with (i) your acts or omissions on the Website including in relation to the advertisement, promotion or sale of tickets on the Website) or (ii) any breach of these Conditions or any third party intellectual property rights.; or (iii) any third party or governmental claim that involves, relates to or concerns (i) any local, regional, country, or international tax obligation or amounts due or owing under any tax regulation, law, order or decree or (ii) any dispute concerning the tax status of Tickex.

12. Miscellaneous

12.1 You and Tickex, are independent contractors, and no agency, partnership, joint venture, employer-employee or franchisor-franchisee relationship is intended or created by these Conditions or your use of the Website.

12.3 Except as expressly stated otherwise, all notices to you shall be sent to the email address you provide to us as part of the registration procedure. Such notice shall be deemed given one business day after the email is sent. We may also use text messages (SMS) to send notices to you. This is solely at our discretion and may otherwise be discontinued as we please.

12.4 You acknowledge and agree that it has no right, title or interest in any of our patents, trade marks, trade names, service marks, copyrights, content, graphics, logos, buttons, images, audio clips, and computer programs and other intellectual property ("Intellectual Property)” other than that conferred expressly by these Conditions and that all such rights, titles or interests in the Intellectual Property shall be owned exclusively by Tickex, and that you will be entitled to use the Intellectual Property only as herein set out. You further acknowledge and agree that nothing in these Conditions shall be construed as an assignment or grant to you of any right, title or interest in or to the Intellectual Property save for the licences granted by these Conditions. You will not now or in the future contest the validity of Tickex,'s Intellectual Property. The look and feel (meaning the collection, arrangement, and assembly) of all content on the Website is the exclusive property of Tickex, and protected by country and international law. Any unauthorised reproduction, modification, distribution, transmission, republication, display, or performance of the software or the content on the Website is strictly prohibited.

12.5 The failure to exercise a right or remedy provided by these Conditions or by law does not constitute a waiver of the right or remedy or a waiver of other rights or remedies. A waiver of a breach of any of the terms of these Conditions does not constitute a waiver of any other breach or default and shall not affect the other terms of these Conditions. A waiver of a breach of any of the terms of these Conditions will not prevent a party from subsequently requiring compliance with the waived obligation.

12.6 In the event that any provision (or sub-provision) of these Conditions shall be void or unenforceable by reason of any provision of applicable law, it shall be deleted and the remaining provisions hereof shall continue in full force and effect and, if necessary, be so amended as shall be necessary to give effect to the spirit of this agreement so far as possible.

12.7 The parties each acknowledge and agree that these Conditions constitutes the entire agreement and understanding of the parties in respect of its subject matter (and supersedes any previous agreement between the parties in respect of such subject matter) and that in entering into these Conditions, it has not relied on and shall have no remedy (either in contract or tort) in respect of any statement, representation, warranty or understanding which is not expressly set out in these Conditions provided nothing in this clause shall operate to limit or exclude any liability for fraud. No amendment to these Conditions shall be effective unless it is in writing and signed by both parties.

13. Assignment

We shall be able to assign any of our rights and obligations under these Terms and Conditions provided that your rights are not adversely affected.

14. Third Parties

Any person not a party to these Terms and Conditions shall have no rights under the Contracts (Right of Third Parties) Act 1999 to enforce any term of these terms and conditions. This Act may give in some cases rights to third parties to act, but in this case only we have rights and obligations under this contract.

15. Governing Law

These Terms and Conditions shall be governed by and construed in all respects in accordance with Unites States law. As well as all English, Scottish and Northern Ireland laws.
